Fisher
& Sauls represents institutional and individual lenders as well
as borrowers in the analysis, development and structuring of
loan documentation.
When
representing lenders, we review loan terms and assist in
structuring loan and security documents by coordinating the lender's
goals with the borrower's objectives.
Our
representation encompasses all categories of loans, including
construction, refinance, lines of credit, letters of credit,
secured transactions financing, acquisition and development and
consumer financing.
Our firm also
has broad experience in reviewing regulatory requirements of
both state and federally chartered financial institutions.
In addition to reviewing institutions' current procedures and
advising of changes to meet compliance, we also review and
assist in drafting required regulatory disclosure and financial forms to
bring an institution within compliance.
Our firm has
represented Lenders in a variety of transactions and litigation.
We provide expertise in connection with all aspects of Florida
financing issues, including documentary stamps and title
insurance issues. As regular counsel for a number of
financial institutions, we are frequently called on to handle
matters that are time-critical and complex.
In both the
commercial and consumer lending areas, we have worked with the
State Comptroller's Office, the Federal Reserve, the Federal
Home Loan Bank Board, the Comptroller of the Currency,
Resolution Trust Corporation ("RTC") and
the Federal Deposit Insurance Corporation ("FDIC"). Among clients we have represented in this area
are: commercial
banks, savings and loan associations, savings banks, credit unions, mortgage companies, commercial developers
and corporate borrowers.
